Welcome to Kartlly ("we," "us," "our"). These Terms of Service ("Terms") govern your use of our website kartlly.in and your purchase of products from our online store. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website.

These Terms constitute a legally binding agreement between you and Kartlly, operated by Kartlly, having its registered address at Ahmedabad, Gujarat, India.

1. Account Terms

1.1 To place an order with us, you may create an account or check out as a guest. If you create an account, you must provide accurate, current, and complete information.

1.2 You must be at least 18 years of age to make a purchase from Kartlly. By using this website, you confirm that you are legally capable of entering into a binding contract under the Indian Contract Act, 1872.

1.3 You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. Please notify us immediately at roshanchauhandotnet@gmail.com if you suspect any unauthorized use of your account.

1.4 We reserve the right to suspend or terminate accounts at our discretion if we detect fraudulent activity, violation of these Terms, or misuse of the platform.

2. Pricing and Payment

2.1 All prices listed on our website are in Indian Rupees (INR / ₹) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise.

2.2 We reserve the right to change prices at any time without prior notice. However, once your order is confirmed, the price at the time of order will apply.

2.3 We accept the following payment methods: Credit/Debit Cards, Net Banking, UPI, Wallets, and Cash on Delivery (COD) where applicable. Payments are processed securely through Razorpay. We do not store your card or banking details on our servers.

2.4 In the rare event of a pricing error on our website, we reserve the right to cancel the affected order and refund the full amount paid. You will be notified via email before any such action is taken.

2.5 For COD orders, you agree to accept and pay for the order upon delivery. Repeated refusals to accept COD orders may result in account suspension.

3. Product Descriptions

3.1 We make every effort to display products and their descriptions as accurately as possible. However, we do not guarantee that product colors, dimensions, or other details displayed on your device will be completely accurate, as variations may occur due to screen settings, photography, or lighting conditions.

3.2 Product descriptions, specifications, and availability are subject to change without notice. We reserve the right to modify or discontinue any product at any time.

3.3 All images, descriptions, and content on our website are the property of Kartlly or our suppliers and are protected under applicable copyright and intellectual property laws.

4. Order Acceptance

4.1 Your order constitutes an offer to purchase the selected product(s). Our acceptance of your order is confirmed only when we send you an order confirmation email.

4.2 We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including but not limited to: product unavailability, errors in pricing or product information, suspected fraud, or inability to verify your shipping address.

4.3 If we cancel an order that has already been paid for, a full refund will be issued within 5–7 business days to the original payment method.

4.4 Orders can be modified or cancelled by the customer only before the order is shipped. Once shipped, the order cannot be cancelled — please refer to our Returns Policy.

5. Shipping and Delivery

5.1 We ship across India through our trusted courier partners. Shipping charges, if applicable, will be clearly displayed at checkout.

5.2 Estimated delivery timelines are 3 to 7 business days from the date of order confirmation, depending on your location. Remote or rural pin codes may take longer.

5.3 Delivery timelines are estimates only and are not guaranteed. Delays may occur due to circumstances beyond our control including weather, courier service issues, strikes, holidays, or force majeure events.

5.4 Risk of loss and title for products pass to you upon delivery to the shipping address provided at checkout. Please ensure your delivery address and contact details are accurate.

5.5 If a package is returned to us due to an incorrect address, failure to accept delivery, or repeated unsuccessful delivery attempts, the customer may be charged additional reshipment costs.

5.6 We currently ship only within India. We do not offer international shipping at this time.

6. Returns and Refunds

6.1 We want you to love what you buy. If you're not satisfied, you may request a return within 7 days of receiving your order, subject to the conditions below.

6.2 To be eligible for a return, the product must be:

  • Unused, unworn, and in its original condition
  • In the original packaging with all tags, labels, and accessories intact
  • Accompanied by proof of purchase (order ID or invoice)

6.3 The following items are not eligible for return or refund unless defective or damaged upon arrival:

  • Personal care, beauty, and hygiene products
  • Innerwear, swimwear, and intimate apparel
  • Customized or personalized products
  • Items marked as "Final Sale" or "Non-Returnable" at the time of purchase
  • Digital products or gift cards

6.4 To initiate a return, please email roshanchauhandotnet@gmail.com with your order ID, reason for return, and supporting photos (if applicable). Our team will respond within 2 business days with return instructions.

6.5 Refunds are processed within 5–7 business days of receiving and inspecting the returned product. Refunds will be issued to the original payment method. For COD orders, refunds are processed via bank transfer to the account details provided by the customer.

6.6 Shipping charges (if any) are non-refundable, unless the return is due to our error (wrong item shipped, defective product, etc.).

6.7 In the event of a damaged or defective product, please notify us within 48 hours of delivery with photos of the product and packaging.

7. Prohibited Uses

7.1 You agree not to use our website for any unlawful purpose or in any manner that could damage, disable, or impair the website. Specifically, you agree not to:

  • Use the website to transmit viruses, malware, or any harmful code
  • Attempt to gain unauthorized access to our systems, databases, or other users' accounts
  • Copy, reproduce, scrape, or redistribute any content from our website without written permission
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the website in any way that violates applicable Indian laws, including but not limited to the Information Technology Act, 2000, and the Consumer Protection Act, 2019
  • Post, upload, or transmit any content that is defamatory, obscene, threatening, or violates the rights of others
  • Use automated systems, bots, or scripts to place orders or scrape data
  • Engage in fraudulent activity, including but not limited to chargebacks without legitimate cause

7.2 Violation of these terms may result in account termination, order cancellation, and/or legal action.

8. Intellectual Property

8.1 All content on our website — including logos, product photos, text, graphics, designs, and the Kartlly brand — is the exclusive property of Kartlly or our licensors, protected under Indian intellectual property laws.

8.2 You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

9. Limitation of Liability

9.1 To the maximum extent permitted by applicable law, Kartlly, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products, including but not limited to loss of profits, data, goodwill, or other intangible losses.

9.2 Our total liability for any claim arising from your purchase, whether in contract, tort, or otherwise, shall not exceed the amount paid by you for the specific product giving rise to such claim.

9.3 We do not warrant that the website will be uninterrupted, error-free, secure, or free from viruses. You use the website at your own risk.

9.4 Nothing in these Terms shall limit or exclude our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Indian law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kartlly, its owners, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or the rights of a third party.

13. Governing Law and Jurisdiction

13.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

13.2 Any disputes, claims, or disagreements arising out of or related to these Terms, your use of the website, or your purchase of products shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

13.3 Before initiating any legal action, both parties agree to attempt resolution through good-faith negotiation. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, at the discretion of Kartlly.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, wars, riots, government actions, courier service disruptions, or internet outages.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
